Terms and Conditions

The designs and/or any redesigns are artistic representations of the site by Designer Hala Issa of Landscape Designs by Hala Issa (collectively, the “Designer”) for landscaping improvements based upon the site condition at the time of the onsite visit by the Designer.

All site conditions may not have been visible during the onsite visit by Designer and may not be reflected in the design drawing and site adjustments. Further modifications to the design may be needed at the time of installation based upon discovered or new site conditions.

Elevations may change during construction. Additional improvements or changes to hardscape and wall dimensions may be necessary. Modifications to the agreed to design services may be requested to incorporate these changes and are available at hourly rates.

Adverse environmental conditions or materials should be disclosed to the Designer by the property owner during the design process. Designer is not responsible for any existing environmental conditions or materials and assumes no liability therefore, or for the worsening of any such conditions or materials.

The Designer cannot be held liable for any misrepresentation on the design, or any redesign needed due to any unforeseen, unknown, or changed conditions. Including the purchase of plant materials during the design process. Incorporating newly purchased plant material after the design is complete can be added to the plan at an hourly rate.

Any design provided by Designer is limited solely to the property of owner, is specific to the owner, and may not be transferred, assigned or used for the benefit of any other person.

Any referral to installers provided by Designer are for your convenience and Designer makes no representation or warranty regarding their work and assumes no liability therefore. Questions or concerns regarding the installation should be addressed only to the installer and not Designer.

In no event is Designer liable to the property owner for any incidental, consequential or punitive damages. Any liability of the Designer for its design and related work shall at no time exceed the amount paid by the property owner to the Designer.

A design is not final and the owner shall not acquire any rights to own and/or use the design until full payment is received by Designer and the design marked as final and signed by Designer.

Invoices from Designer shall be due and payable upon receipt. Invoices not paid with in 15 days will incur 10% penalty of invoice total for every week over due.
